Good Afternoon everyone!

I would like to ask for the implications of the NOA for approval, if it exceeded 7cd.
We have forwarded the NOA to our HOPE last April 22, 2014 until now it was not yet approved.

for as long as procurement process from the opening of bids up to the award of contract shall not exceed three (3) months as indicated under section 38.1. However, the HOPE shall be subjected to administrative case if he/she has not valid, compelling and reasonable grounds for delaying the required 7 calendar days under section 37.1.2

is it mandatory that the bac disqualify the awardee if it fails to post the performance bond? or can the lgu carry on with the contract minus the performance security? can the bac justify through a resolution that the awardee by negotiation is the only interested supplier but only it is not registered with philgeps?
