Conduct bidding process in advance for the next year's budget

Anybody have an idea if it is ok to start posting to philgeps (like this month of dec.2014) for the projects to be implemented in the next year's budget (2015)?

Hi Sir!

The idea is not in accord with existing rules and laws since there is still no Source of Fund for the project to be implemented in the absence of a law/ordinance authorizing the appropriation of funds.

First, the Approved Budget for Contract (ABC) for the project is based on an existing law/ordinance authorizing the appropriation of the funds. In the absence therefore of such law/ordinance, then there can be no ABC. And when there is no ABC, then there can be no procurement.

Second, Section 7.1 of the Revised IRR states that "All procurement shall be within the approved budget of the procuring entity and should be meticulously and judiciously planned by the procuring entity". It is therefore mandatory that the projects to be procured are in accord with the law/ordinance.

That is permissible.

The rule requires to procure only in accordance with the APP. If there is already an APP, and after assessment (like pre-procurement conference) the procuring entity is now ready to procure, notwithstanding the fact that it is not yet 2015, procurement may be undertaken and posting in the PhilGEPS may start already. However, since obligation (ObR) is required before you enter into contract, you will have to wait for 2015 before you can obtain it. But still, you can plan your procurement ahead so that Notice of Award falls on 2015 to comply with accounting and auditing rules.

If there is already an approved APP then there already is an approved budget. There is no question that you can start processing it. As engrjhez has pointed out, it is possible if the budget source is already available. On my part, I assumed that there was still no approved appropriation for 2015.
