Procurement thru PHILGEPS registered supplier

Is the procuring agency obliged/ mandated to accept the prices quoted by suppliers with PHILGEPS registration, even if prices offered are considerably high compared to supplier without PHILGEPS?

It depends.

The rule is that the supplier with the lowest calculated and responsive bid is entitled of the award, and thus the procuring entity is bound to accept. However, it is premised on the fact that the supplier is "responsive", i.e. they are legally, technically and financially capable. In other words, its is not PhilGEPS registration alone that qualifies a supplier. PhilGEPS registration is only one of the mandatory requirements.

Thus if a PhilGEPS registered supplier offers the lowest price/bid but does not pay taxes and/or financially insolvent, or in any case disqualified under the law, the procuring entity cannot accept the proposal. Instead, the supplier should be disqualified.

If on the other hand a PhilGEPS registered supplier offers the lowest price/bid and is compliant on all eligibility, technical and financial requirements required by law, the procuring entity is duty bound to accept such offer.

As to non-PhilGEPS registered suppliers, they are not entitled of any consideration even if they participate in the procurement and their prices are lower than their PhilGEPS registered counterpart. The only ruling they can have is disqualification particularly on publicly bidded projects.

It is the government that imposes requirements such as PhilGEPS registration. It will be a mockery of the system if government procuring entities will tolerate/entertain non-PhilGEPS registered suppliers in their bidding projects.

Mga sirs, please help me enlighten about those service providers that are not PhilGEPS registered most especially catering services in a certain place for the meetings. Is this illegal for awarding them?

may mga ganyang cases talaga po lalo na sa mga municipalities na di pamilyar sa PhilGEPS ang mga supplier, as long as walang ibang may PhilGEPS na magqoute I think mauunawan naman yan. But then irequire nyo sila na mag register sa philGEPS after all kung sila lang may philGEPS yung catering services ei sila na agad ang qualify. hikayatin nyo sila na advantageous sa kanila kung magpapamember sila dahil mandate yun ng RA 9184.

This scenario:

We have an Approved Budget for the Contract: Php 45,000.00

Supplier A: Quoted Php 40,000.00
Supplier B: Quoted Php 42,000.00
Supplier C: Quoted Php 39,000.00

Note:
Supplier A & C are not PhilGEPS registered while Supplier B is a PhilGEPS registered.

Do we need to award to Supplier B regardless of how much amount they quoted as long as still not beyond the ABC? Please enlighten us mga sirs & mams.

It depends on the Mode of Procurement. Please take note of the inclusion of new provision in the IRR:

54.6 Manufacturers, suppliers, distributors, contractors, and/or consultants are mandated to register with PhilGEPS and provide a PhilGEPS Registration number in the following alternative methods of procurement as a condition for award of the contract:
(a) Section 49 Limited Source Bidding
(b) Section 50 Direct Contracting
(c) Section 51 Repeat Order
(d) Section 52.1 (b) Shopping for Ordinary Office Supplies and Equipment not available in the Procurement Service
(e) Section 53.1 Two Failed Bidding
(f) Section 53.3 Take Over of Contracts
(g) Section 53.4 Adjacent and Contiguous
(h) Section 53.9 Small Value Procurement
(i) Section 53.10 Lease of Real Property
(j) Section 53.11 NGO Participation

EXCEPT for the following:
(a) Section 52.1 (a) Shopping under Unforeseen Contingency
(b) Section 53.2 Emergency Cases
(c) Section 53.5 Agency to Agency Agreements
(d) Section 63.6 Procurement Agent (except private procurement agents)
(e) Section 53.7 Highly Technical Consultants
(f) Section 53.8 Defense Cooperation Agreement
(g) Section 53.12 Community Participation
(h) Section 53.13 United Nations Agency”

The Rules now recognize certain alternative methods of procurement where registration with PhilGEPS would be impractical and/or unnecessary. Those are the excepted modes above.

Sir Engr. Jhez, the method of procurement will be under Section 53.9 Small Value Procurement but the problem is that the activities/meetings will be in the province. And mostly carenderia for the provision of food for the participants. Please enlighten us sirs and mams..
