Negotiated Procurement - small value

good day!

I hope someone will answer my query:

1. Do we need to require the following documents aside from the Business Permit and DTI / SEC Cert. to the participating suppliers under the mode of Negotiated Procurement (Small Value):
  * PhilGEPS Cert.
  * Tax Clearance
  * Income Tax Return

In GPPB Resolution 30-2013 PhilGeps Registration Number is to be required from suppliers in the case of small value procurement. As for Tax Clearance and Income Tax Return it is my opinion that such documents are not mandatory requirements. As per GPPB Reso 09-2009 as long as the PE assured itself that it is entering into a contract with a supplier that is legally, financially and technically capable, the PE can determine such through evaluation of relevant documents.

Good day,

In my opinion, we can only determine whether a supplier is legally, financially and technically capable through evaluation of the documents as mentioned and through site/store/office visit, if necessary. Those documents can also be used for the Supplier Accreditation for inclusion in the supplier registry so that everytime you need to procure through alternative modes of procurement you can easily identify suppliers for RFQ.

The GUIDELINES FOR SHOPPING AND SMALL VALUE PROCUREMENT provides that:

"The procuring entity must validate whether it is entering into a
contract with a technically, legally and financially capable supplier,
contractor or consultant by requiring the submission of relevant
documents or through other means."
