prolonged suspension

our project which has a contract duration of 120 cd has been suspended for more than 200 cd due to erroneous data reflected in the plans (e.g. elevations) and was resumed last nov 2014 and once again, was suspended for almost 90 days and was resumed last march 2015, however until today, the variation order due to changes in the plans is still on process. The program is about to expire this coming july 2015 and our accomplishment as of today is less than 50%. My question is, are we still entitled for a mutual termination due to the aforementioned circumstances despite the fact that we failed to inform the PE in writing, regarding our intention for a mutual termination? thank you.
