Checking of Eligibility Requirements before the Scheduled Submission and Opening of Bids

Most of our bidders were being declared ineligible for failure to comply/submit documents during the opening of eligibility requirements.

In this regard, can we require bidders or can we check the eligibility documents of participating bidders before the submission and opening of bids?

Can the BAC still apply the two (2) stages of bidding (first stage - Submission and opening of eligibility requirements; second stage - submission and opening of technical and financial proposals) for civil work projects?

your best option to educate the bidder is during the pre-bid conference. The procuring entity may initiate a round down of the requirements to ensure completeness and validity of the the documents to be submitted. Section 22.3. provides that "The pre-bid conference shall discuss, among other things, the eligibility requirements and the technical and financial components of the contract to be bid." This provision i believe allows you to discuss all requirements to the bidder.

Good AM.

I would like to inquire if the construction experience of a mother construction company can be used by its affiliate or subsidiary construction company as part of its construction experience and eligibility for a proposed airport project in the Philippines and locally funded?

The case at hand is that the mother construction company has extensive construction experience while its affiliate or subsidiary construction company is just starting and has no construction experience.

these are two separate entity and the experience of the mother or sister company cannot be used by the prospective bidder. what you can do is to join the bidding through a joint venture. the irr provides that:

Valid joint venture agreement (JVA), in case the joint venture is already in existence. In the absence of a JVA, duly notarized statements from all the potential joint venture partners stating that they will enter into and abide by the provisions of the JVA in the instance that the bid is successful shall be included in the bid. Failure to enter into a joint venture in the event of a contract award shall be ground for the forfeiture of the bid security. Each partner of the joint venture shall submit the legal eligibility documents. The submission of technical and financial eligibility documents by any of the joint venture partners constitutes compliance.(a)

Additionally, does this apply if the mother construction company is a foreign contractor while its affiliate or subsidiary construction company is a newly established local contractor?
