Query on BAC Composition

Post by olrac_tm on Mon Jul 11, 2016 1:20 pm

Dear all,

May i request for your comments, we just told that a BAC Chairperson and Vice-Chairperson can have each an alternate? our practice in our office is that we have BAC Chairperson and Vice-Chairperson but with no alternate, only members has alternate.

If that so is correct for having alternate for the BAC Chair and Vice Chair, can the alternate BAC Chair preside over the Vice-Chair (not the alternate vice chair)?

your comments are appreciated. Thank you.

Section 11.2.4 of the IRR makes no distinction:

11.2.4. The Head of the Procuring Entity may designate alternate members to the BAC, who shall have the same qualifications as their principals as set in the Act and this IRR. The alternate members shall attend meetings of the BAC and receive the corresponding honoraria, whenever their principals are absent. The alternate members shall have the same term as their principals. The accountability of the principal and the alternate member shall be limited to their respective acts and decisions.

Thus, the HOPE may designate alternate BAC members even to the Chair and the Vice Chair.

For LGUs, it is my OPINION that the same is applicable. If the BAC Chair is absent, his alternate will preside, provided the alternates were specifically identified in the designation (because there is complication in case of LGUs). The Vice Chair will only preside if neither the BAC Chair nor his alternate is available.
