Sandiganbayan convicts Davao Sur mayor of graft

Excerpt from the article in The Philippine Star

The Sandiganbayan has sentenced a town mayor of Davao del Sur to a maximum of 10 years in jail for purchasing a generator worth more than P1.6 million that later proved to be useless.

The graft case against him stemmed from the direct purchase of a Komatsu diesel generator from Marubeni Corp., a foreign corporation based in Singapore nine years ago.

The machine valued at P1,694,787.30 was supposed to supply electricity to the Municipal Hall of Jose Abad Santos but it was never used because its features were found to be incompatible with the building's existing electrical wirings.

The Office of the Ombudsman filed charges against Lachica for making the purchase without the conduct of a technical engineering study or a project design to determine its viability.

Hmm.

Please also take note that. The procurement was undertaken before RA.9184 came into existence, hence RA.7160 shall govern this procurement.

Yes, thank you sir. I noted that the purchase was made long before RA 9184 took effect. Nonetheless, I posted it because the issue that sparked the case is still relevant to the rules existing now.

I believe this news highlights the necessity of studying the specifications of the item to be procured, as can be read from the above-quoted portions.

Whether 9184 o 7160 pa yan, i think the issue hear is that, definitely there was a violation to a certain law. that is why precaution at dapat maingat tayo. anyways mayor Lachica could always appeal the decision, just like mayor joey marquez on his case of overpriced walis tingting. yan ang justice system natin. heh.he.

Yun nga ang justice system sa atin: kung hindi ma-convict sa trial by publicity, kandidato naman later on sa acquittal sa Supreme Court. Parang yung most celebrated Plunder Case ay nauwi sa Presidential Pardon, hehe.
