The important is that the financial offer of that particular bidder is intended to specific Lots. The issue here in my understanding was that the docs intended for LOT 1 was placed in LOT 2 same with docs for LOT 2 was placed in LOT 1. Assuming you grant the MR, you will read the correct one, meaning if you deliberate the LOT 1 you must get the offer of that bidder LOT 1. If the other bidders will contest, then you have to explain to them that it was not a ground for failure. It's a matter of explaining to them.

The BAC has discretion to accept or not to accept the bids. Its just the markings. What we are trying to avoid here is the tampering of the bids. Please refer to this "20.5.If bids are not sealed and marked as required, the Procuring Entity will assume no responsibility for the misplacement or premature opening of the bid."

bidding namin ngayon. na D.Q kami kasi yung envelope ay walang signature kaht na ang nakalagay sa loob na envelope at naka sealed n may signature is ground of disqualification

what type of MR we need to reply to the BAC regarding this problem because the disqualification of the bidding is part of sealing and marking of envelope

If the bidder acknowledged that his bid were not sealed and signed, It should be considered. Substance over form.

what did you mean.? the envelope submitted is sealed and signed
the mother envelope there's no signed then the other no singed but the bac said duly signed each envelope., but when you open the second envelope each of this is sealed and signed

As i said earlier, the BAC has the discretion to accept or not, but if u were to ask me if this should be accepted, my answer would be YES!, we should accept, its just a markings, we should be focusing more on the content of that envelopes. If we are so strict with simple things like this, i bet we will have a fail bidding.
