Motion of Reconsideration

Hi. Sir.,

Sir i ask a question regarding the MR (Motion of reconsideration) if the bidder is failed during the the opening
then some of bidder is passed. the bidder failed during opening of bid she/he file the MR. then if granted the letter the some of bidder passed is required to invite to witness to open of the envelope of the one bidder. it is required or not

i have a experience during bidding I'm the one passed during opening of the bid out of Three Bidders the rest is failed then after that one of the bidder filed the MR letter. then after two months the procuring entity we call then to update the status of my winning project but he said there's one bidder was filed the MR letter it is granted. but never notify us about this it is required to invite other bidder to witness the opening of financial envelope

A Motion for Reconsideration (MR) just like any transaction in the government must be dealt with or complied accordingly in a timely manner. The reply of MR must be served within seven (7) calendar days (Sec.55.1) if it is accepted or not by the PE. This is consistent with the Anti-Red Tape Act (RA 9485), where simple transactions must be responded or replied accordingly within five (5) working days. Very Happy

The BAC is required to reply within 7 days upon receiving the MR.
