No Brand Name in the submitted proposal

Good Day!

I just want to inquire if the law (procurement of goods) allows bidders to submit a proposal without any specific brand names? Hoping for your immediate response. What provision in the RA 9184 and its IRR can I find it? Hoping for your immediate response. Thanks a lot!

If not clearly stated in the PE's bidding documents, the supplier is not oblige to do so. There will be a post-qua for the LCB if their offer will meet the PE's specs.t But if clearly stated in the bidding documents, a supplier can offer different brands even for one lot item as long as the specifications of such brands conform with the specifications required by the the Procuring Entity.

Thanks for the response. In the PE's documents there are specifications but no brand name. In the bidder's proposal there is no specific brand name. For example in the PE's specifications it states 10 units of BCG Vaccines in 20ml vial. Bidder's response is just comply. Is it acceptable? How would the TWG verify if it conforms with the specifications? Thanks

After the PE have the LCB, this will be subject for post-qua. The TWG will have to check if the LCB is truly comply with the PE's specifications.

So it will be on the TWGs discretion if they would allow proposals with no specific brand? Is there no provision in the procurement law which states for a concrete offer, meaning with brands and model? Thanks for your prompt response.

TWG have no discretion as procurement is concern. The decision making will be the BAC and TWG will only help the BAC during post-qua in determining if the LCB comply with the minimum specs stated by the PE in the bidding documents.

If found out that the LCB did not comply with the PEs specs, the BAC will recommend to HOPE a post-disqualification on their report.
