Changes made by the Procuring Entity to the standard PBD Instruction to Bidders

HI!

Is the Procuring Entity allowed to make changes to the standard PBD Instruction to Bidders?  Our company was recently declared failed for not complying to a requirement that they posted under the "Instruction to Bidders", and the same requirement was not specified in either their Bid Data Sheet (BDS), nor in their Special Conditions  of the COntract (SCC).  Is this grounds for failed bidding ?

As far as I know we (Procuring Entity) can only modify the BDS and SCC . but since there is a new IRR effective this Oct 28, 2016, with the absence of the new PBD some modified the 4th edition PBD to cater the changes in the latest IRR.
