submission of LOIs simultaneous with bid docs purchase in revised IRR?

does the revised IRR really require the outright bid docs purchase upon a contractor's submission of his LOI, even without the results of eligibility yet?

i have have noticed in some DPWH districts' procurement schedules that issuance of bid docs go as early as even before the deadline for the submission of LOIs which could mean that eligibility is therefore not a prerequisite anymore in the issuance of bid docs.

there have also been stories going around that a particular district even demanded that contractors pay up not only for the LOI but also for the bidding documents already, upon their submission of LOI.

is this really the case for the revised IRR?

I think there are many discussions already with regards to LOI on this forum... If you take a look at Annex "C" of the new IRR, the LOI is no longer a requirement anymore for procurement of Infrastructure and Goods (even for consultancy). Accordingly, only procurement of Consultancy requires an LOI.

The Bid documents must already be prepared and available at the first day of posting since under the amended IRR the period of purchasing of Bid Docs must be available from the 1ist day until the last day/opening of Bids.
