Exceed the ABC

Dear Sirs/Madam

Gud AM

ng bid kami for IT equipment worth P900+K hindi lumpsum bid kundi per item.. may ibang items na ng exceed sa budget kasi underestimed ang na set naming budget, so failed bidding for those items. Since less than 100K na lang naman ang mga items na natirang exceed sa budget, pwede na ba naming gawing shopping ang mode of procurement (to request approval of the BAC for change of mode) at ano na ang magiging basis namin na budget? pwede ba namin basehan ang bid price ng supposed to be lowest and complying bidder? pls advise us kasi kailangan na yung ang mga items at saka mag close na book for this year.

I will answer your question based on the facts that you presented.

1. Pwede bang shopping ung 100K worth na IT items? I believe that sa small value procurement sya papasok. But base the facts na binigay mo your violating the provision of the revised IRR on splitting of contracts.

Basis: I am on the presumtion that the first bidding, the ABC for those IT items is 900K, and you only got some items for the ABC 900K. and now you want to conduct a bidding for the rest of the unprocured items in the 1st bidding. (even if the items are priced as per item still the limit is the ABC)

2. Anong magiging basis ng inyong budget? wala kasi naubos na ung budget nyo sa first bidding. (wala akyong budget kasi exhausted na sa first bidding)

3.pwede bang basehan and bid price ng supposed to be the lowest and complying bidder (for budget)? make a market research. Please refer to Section 7 for procurement planing.

Hindi splitting of contract un kasi galing din sa 900k ung budget, ang nangyari lang ilang items dun sa 900k ang nag exceed sa per item budget kaya failed.
Eto ang example ng ibang items na ngfailed because it exceeds the ABC:

Item ABC Bid price
1 unit hard drive 320GB 4,000 4,800
2 units hard drive 400GB 11,000 11,400
2 units memory 5,000 5,120
etc.....

kaya ask ko kung pwede na lang shopping ang items na ito since less than 100k na lang ang naiwan doon sa 900K? hindi ito pasok sa small value procurment kasi reqular office/IT equipment ang mga ito.

Granted the original conditions in the bidding was followed, say for example, if the original condition was public biding, then the BAC can recommend to the HOPE for the use of the alternative mode in order to promote economy and efficiency, provided also, that the most advantageous price for the government is obtained. NOTE: You have prepare revised PPMP and likewise have to update your agency APP. Hope this will help. bounce

Every Procuring Entity can choose on what mode of procurement in their procurement provided they can justify such mode of procurement and cover all the conditions therein however one must bear in mind that all dealings is the responsibility of such Procuring Entity.

eto po kasi meaning ng splitting kaya nasabi ko un...

54.1. Splitting of Government Contracts is not allowed. Splitting of Government Contracts means the division or breaking up of GOP contracts into smaller quantities and amounts, or dividing contract implementation into artificial phases or sub-contracts for the purpose of evading or circumventing the requirements of law and this IRR, especially the necessity of public bidding and the requirements for the alternative methods of procurement.

I definitely agree, its no splitting of contract, cause there are items or some of the items cannot be awarded for reasons above the ABC, hence failure. bounce

Based on your presented scenario, I would say it is NOT splitting. In fact, literal splitting of contracts per se is not a violation unless a circumvention of the law, particularly on evading Public Bidding as a default mode of procurement, is committed. You have done your part on adopting initially Public Bidding. Kaya lang, hindi 100% nag work out. Considering the closing of book of accounts are coming near, it can be justified thru a BAC resolution the change of mode of procurement. The remaining of the available fund must be realigned properly kasi kung understated talaga yung mga prices, you will have to change unit prices, and hence quantities.

FYI, Shopping is allowed up to P500,000.00 for NGAs, GOCCs, GFIs, and SUCs. (Sec.52.1.b Annex "H")

Good Day ...
Please take note that you have to prepare a New PPMP for those items you are mentioning that were not awarded due to above ABC and as what have mentioned by engrjhez we have various threshold for shopping just check if you project will fall on the alloted amount for SUCs..... It is almost closing and the activity now is more on the inventory for anding year 2009 so you have to expedite the necessary resolutions of the BAC too...
