Lease of space of a government office

Good day furom members. In the ground floor of our office we have a vacant space, we intend to offer it for canteen space for private lease. What particular mode in Revised IRR is applicable?

Its not a procurement matter its disposing or leasing of property I believ you are covered by public auction but I am not sure if what specific law. You could try this one COMMISSION ON AUDIT CIRCULAR NO. 89-296 January 27,1989

there is no particular mode in the Revised IRR is applicable because it is not covered by R.A. 9184.. to be subject to the Revised IRR there must be a public fund to be used.. in your case you will not used any public fund instead you will gain money..

Good day.....
COA circular 92-386 has the provision on leasing public space to private institution you can browse on this circular as well as the GAAM (government accounting and auditing manual) for your perusal sir.
In the LGU we have a Local Committee on Award (different from the Local Bid and Award Committee(BAC)) they facilitate whatever is not included in RA 9184 . Through a Department/Special Order perhaps you can create a committee who will handle the provisions on leasing since this is an income generating activity....

I believe that COA CIR 92-386 is already repealed by RA 9184 see

Second I think the owner of the property to be leased is the government and not private owner.

Third in such a case that the government will lease a private property the revised IRR of RA 9184 will apply under the section of lease of private property.

Forth if the government will lease or dispose public property I believe that RA nor the IRR shall apply you could try COA Circular 89-296.
