Bidding Proper

Hi to all. I just want to clarify something, can a job order who is part of the BAC Secretariat can seat down in behalf of the BAC Secretariat who is on official travel during the Eligibility Check, Opening of Bids and Post Qualification of Bids?

Can she perform the task deligated to her by the BAC Secretary?

hi slayer,

first of all, let me get ur question clear-u r asking whether a job order employee that is part of the BAC Secretariat can perform the job of a full-time permanent employee that is a part of the BAC Secretariat during the opening of bids when the latter is not present?

if I got ur question right, then in my opinion, the work of the secretariat during the opening of bids is purely clerical, hence, I see no problem in the case u just mentioned.

First of all, let us clarify that the personnel under BAC Secretariat must be holding plantilla (permanent) positions before he/she can be appointed.

Section 14.1 of the IRR states that:

The head of the procuring entity shall create a Secretariat which will serve as
the main support unit of the BAC. He may also designate an existing organic
office
within the said procuring entity to serve as Secretariat. However, to
strengthen and promote the professionalization of the organizations’ procuring
unit, he may reorganize this unit by designating it as BAC Secretariat and
redeploying appropriate existing personnel to it to perform this function, as well
as procurement related task.


The idea that a BAC Secretariat SHALL be created pertains to a NECESSITY. Job Orders (contractual employees) cannot be main support unit of BAC it its personnel is not even secured of his/her position.

The Secretariat shall have the following functions
and responsibilities:
1. Provide administrative support to the BAC;

This is very lethal!

2. Organize and make all necessary arrangements for the BAC meetings;
This has no problem...

3. Attend BAC meetings as Secretary;
This function refers to the entire Secretariat - not only to the Head. Provided he/she is qualified to take the seat as a member of the Secretariat, he/she is expressly allowed to perform the function;

4. Prepare Minutes of the BAC meetings;
As mentioned above, this is only clerical.

5. Take custody of procurement documents and be responsible for the sale
and distribution of bidding documents to interested bidders;

Now this is where accountability intercedes. Job Orders cannot be allowed to accept and perform this very crucial function without proper designation.

6. Assist in managing the procurement processes;
No problem with here.

7. Monitor procurement activities and milestones for proper reporting to
relevant agencies when required;

How can he/she monitor the procurement activities and milestones if after 3 to six months, he/she will be off the payroll?

8. Consolidate PPMPs from various units of the procuring entity to make them
available for review as indicated in Section 7 of this IRR-A;

Again, this is crucial. If all members of the Secretariat is contractual, the Head of the Secretariat is in a painful HEADache.

9. Make arrangements for the pre-procurement and pre-bid conferences and
bid openings; and
10. Be the central channel of communications for the BAC with end users,
PMOs, other units of the line agency, other government agencies,
providers of goods, civil works and consulting services, and the general
public.


The nature of work suggests that this is both essential and critical designation we must be careful about. In a wider perspective, the TWG may or may not be created - but not the Secretariat.

can the head of the BAC Secretariat delegate his functions to his or her staff that is all job orders?

YES he/she can, subject to his/her accountability. However, I would like to emphasize that the nature of BAC Secretariat's work is so critical that appointment of Job Orders are not always appropriate - and there is no "professionalization package" (as well as accountability) for such contractual employees.

YES he/she can, subject to his/her accountability. Job Orders are not employees of the procuring entity. They can assist the BAC Secretariat on some administrative matters, but delegating the functions to them is, I think, not a good idea. Definitely, he/she cannot be freed from accountability despite the delegation. The more important things to consider are: 1) that would not be in accordance with the intention of the law to professionalize the procurement organizations; and 2) there are certain sensitive informations which could be jeopardized if job orders have access to them and are directly involved in the main functions of the BAC Secretariat.
