Electronic Filing and Payment System

Clarification lang po.. in the Checklist of Eligibility requirements for bidders.. G-EPS AND EFPS are licenses which may be required by the procuring entity concerned.. we require them to be a GEPS registered
my question is...........can we accept a contractor/supplier which is GEPS registered but not a EFPS registered? can we consider them as a eligible bidder or not?

In the revised IRR of RA 9184, neither G-EPS and EFPS are inlcuded in the eligibility requirements. G-EPS or PhilGEPS registration is required in the post-qua process for the lowest calculated bidder. If you mean by EFPS is electronic payment thru the PhilGEPs, that is one of the new/additional feature that will be included in the System by 2011. The PhilGEPS, I believe is working on it.

"eFPS stands for Electronic Filing and Payment System, and it refers to the system developed and maintained by the Bureau of Internal Revenue (BIR) for electronically filing tax returns, including attachments, if any, and paying taxes due thereon, specifically through the internet." - taken from BIR website. It is intended for BIR purposes only. The PhilGEPS still has to create a similar system under e-Commerce law to have its own counterpart.

I think you have to revise your checklist to be consistent with the Revised IRR. What is required under R.A.9184 for eligibility checking is Audited Financial Statement stamped "received" by the BIR. Both PhilGEPS and latest Business/Income Tax are required only on POST QUALIFICATION.

EFPS is the Electronic Filing and Payment System in the BIR which our Auditor requires our contractors/suppliers to be a EFPS registered because according to her if we accept a suppliers which are not a EFPS registered , we are accepting bidders which are ineligible to participate in our procurement..

our bidders submit income tax return which are manually prepared and she wants a electronically prepared itr

Bhabes, Sir engrjhez is right. Pls. update your checklist of Eligibility requirements pursuant to the Revised IRR of RA 9184. If the EFPS is a BIR requirement then it is covered by Section 27/28/29 of the PBD (Goods/Infra/Consulting) as far as Post Qualification of bidder with the lowest calculated bid is concerned. I believe the accounting and COA should be aware of this already since the revised IRR was in effect September 2009 pa.

The revised IRR is silent as whether the income tax returns and business tax returns have to be electronically filed. However, in the Philippine Bidding Document, particularly Item 29.2.(b) of the Instructions to Bidders (ITB), the procuring entity is allowed to specify in the Bid Data Sheet (BDS) whether bidders have option to submit manually filed tax returns or tax returns filed through the EFPS.

I just mentioned that the IRR is (still) silent on the requirement (for EFPS) on the tax returns, although the GPPB has already previously issued a circular in respect to BIR issuances on the matter. So, it is not a matter on which will govern. By stating it, I just want to impress on my observation that the IRR is silent on the EFPS requirement.

Being not privy to the framing up of the IRR, I can't say the reason why. My sense is that, strictly requiring EFPS may not be feasible in the meantime that there are some technical problems being encountered by tax filers using the EFPS, that even the BIR allows manual filing.

Finally, considering that the PBD provides the option to procuring entities (to accept manual or EFPS) maybe what you should ask is, which will prevail the Bidding Document issued by the procuring entity or the BIR regulations?

The question on the eligibility of a bidder who paid his tax returns manually or through the EFPS should not be an issue. As what RDV posted, the GPRA is silent on the matter. This problem can also be avoided if the Procuring entity specifies in its bidding document that bidders can submit tax returns which are manually paid. Under 28.2(b) and not 29.2(b), the Procuring entity can specify whether the bidders can submit tax returns paid manually or through the EFPS. The question that needs to be answered is that asked by RDV. Which of the two will prevail? The Bidding document or the BIR Regulation? For me, it is the Bidding documents for obvious reasons. What says you, my friends.
