House Bill No. 1852

This HB seeks to amend the application of Republic Act (RA) 9184 withdrawing from its application and coverage all references to the local government units. It seeks to re-place the procurement activities of the local government units under the coverage of RA 7160, otherwise known as the Local Government Code.

Section 1 of said HB reads as follows:

All references to the local government units under the provisions of Republic Act 9184, otherwise known as the Government Procurement Reform Act, are hereby withdrawn from its application and coverage.
Section 2 of said HB, on the other hand, states as follows:

Procurement of infrastructure projects, goods, and consulting services by the local government units shall be governed by Title Six, Book Two of Republic Act 7160, otherwise known as the "Local Government Code of 1991."

This HB was introduced on the 14th Congress by Honorable Representative Rufus B. Rodriguez

Now this is better, the HOPE (Chief Executive) as the Chairman of the Committee on Awards, shall be directly responsible for the actions made relative to the procurement. Under the Code, the members of the Committe on Awards are identified, such as, The Local Treasurer, Local Accountant, Local Budget Officer, and the Local General Services Officer, with the head of the offices or deparment for whose use the supplies (WHAT ABOUT THE INFRA?) are being procured, as members.

If this HB was subsequently been passed and the LGU is removed from RA 9184, this will be the start of GPRA's collapse. The main intent of GPRA is to unify the system so as to introduce reforms. If the LGU is excluded, others may appeal also. GOCCs, GFIs, SUCs, etc, and everything comes back where we started before year 2002. Smile
